A BUSINESSMAN'S bid to remove Conwy Council from a court hearing over ownership of Colwyn Bay Pier has been thrown out.
Steven Hunt's application to have the authority removed from proceedings and to have its evidence struck out was overturned by His Honour Judge Jarman QC in Cardiff County Court in a short hearing this morning (Thursday).
Mr Hunt, who has been locked in a legal battle over ownership of the Grade II listed pier on Colwyn Bay promenade, made his application to have the council removed from the proceedings in May, on the basis that it had no locus standi - or right to appear before court.
Failing that, Mr Hunt also made an application to have the Council's witness and expert evidence struck out, arguing that it was incapable of establishing a reasonable defence to Mr Hunt's case for a Vesting Order, which would give him ownership of the structure.
The case will continue in a final hearing over three days, starting on August 6.
The council and Mr Hunt were last before the Court in April for a case management hearing, which set directions for both parties to take the matter to the final hearing.
Sad news for Steve .
